These terms cover your use of the Notiva website at trynotiva.com and the beta signup list. The Notiva app itself is covered by a separate End User License Agreement.

“Notiva,” “we,” and “us” mean Byron Garcia. By using the site or joining the beta list, you agree to these terms. If you don’t agree, please don’t use the site.

Who can use the site

You need to be at least 16 years old to use the site and join the beta list, and the information you give us (your name and email) should be accurate and your own.

The beta list

Joining the list means we’ll email you about Notiva — new builds and release notes, as described on the site. You can unsubscribe or ask to be removed at any time by emailing [email protected]. Being on the list doesn’t guarantee access to any particular build or that the app will ship on any timeline.

Acceptable use

Please use the site normally and in good faith. You agree not to:

• attack, disrupt, overload, or try to break into the site or its underlying services;
• submit someone else’s information without permission, or submit false details;
• scrape, harvest, or use automated tools to abuse the signup form;
• use the site for anything unlawful.

Intellectual property

The look and content of this website belong to Notiva. The Notiva name and logo are our trademarks, and these terms don’t give you a right to use them. Notiva’s app source code will be released as open source under the GNU General Public License v3; when it is, that license — not these terms — governs your rights to the code. Our trademarks remain ours regardless.

Links and third parties

The site links to third-party services (such as GitHub and Discord). We don’t control them and aren’t responsible for their content or practices; your use of them is governed by their own terms.

“As is,” and no warranty

The website and the beta list are provided on an “as is” and “as available” basis. We may change, pause, or discontinue the site or the beta program at any time. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement.

Limitation of liability

To the fullest extent permitted by law, Notiva will not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the site or the beta list. This section doesn’t limit any liability that can’t be limited under applicable law.

Governing law

These terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules.

Changes to these terms

We may update these terms from time to time. When we do, we’ll change the date at the top of this page. Continuing to use the site after a change means you accept the updated terms.
